Should Advocates Turned Politicians Allowed by Political Parties to Defend Economic Offenders
Some thing strange noticed by all of us in Sahara
case. Sahara Shri as Mr Subrat Roy loved to be called was defended in Supreme
Court by two stalwarts of Bhartiya Janta Party Sarva Shri Ram
Jethmalani and Ravi Shankar Prasad. Can a political party which boasts bringing Ramrajya in India justify their leaders to save a person who has been accused
for extremely serious financial irregularities.
The wise people who drafted our Constitution had already envisaged such situation and made a clear separation of Powers between the Legislature, the Executive and the Judiciary. The reason was
quite obvious, if a person is a part of any of the two, no matter how honest
and impartial he is, he would find it extremely difficult to
battle with the perception of a perceived Conflict
Of Interest. There will always be dicy situations, borderline
cases, tempting offers which may impediment in discharging
responsibilities in a free and fair way.
It is also true that many judges long for a rehabilitation post retirement. And we also have lawyers turned politicians still practicing. The politicians have a big role in appointments, setting up committees etc. Is there a bit of intimidation by the clients, when they field politician lawyers to argue their case?
Congress Party - Kapil Sibal, Abhishek Singhvi, Ashwani Kumar, Salman Khurshid, Manish Tewari
Bhartiya Janta Party - Arun Jaitley, Ravi Shankar Prasad, Meenakshi lekhi, Ram Jethmalani
Aam Admi party - Prashant Bhushan, Shanti Bhushan
Apart from these so many spouses of leading
politicians such as Nalini Chidambaram also work as leading lawyer in apex
courts. Many people hires/ take their services in a hope of getting favour their better halves.
It is also true that the entire freedom
struggle movement was led by eminent lawyers of that time right from Mohan Das
Karam Chand Gandhi to Moti Lal Nehru, most of them had given up their roaring
practice for the cause of struggle. Now a days, situation is slightly different,
lawyers tend to join politics to enhance their clout.
It is now people’s turn to identify and reject them
in such politicians in elections.
